Terms and Conditions1. General a) Motoroamer offers motorhomes for hire according to the following terms & conditions. b) The Hirer agrees and affirms to have read and understood this document in its entirety. c) Upon signing the booking form the hirer is legally deemed to have agreed and accepted all these terms and conditions. d) Any disputes will be resolved under English Law. e) No servant or agent of Motoroamer has the right to vary these conditions and no representative, other employee or agent is authorised to commit Motoroamer to any liability whatsoever. Motoroamer will not be responsible for any statement or representation unless signed by a duly authorised member of staff. All figures on our website and other literature and details of vehicles are given to assist with general information and do not form part of any binding contract. f) Hirers should advise if they intent to travel to areas of extreme cold as it is possible the gas, water and diesel fuel may freeze. 2. Definitions a) 'The Hirer’ refers jointly and severally to the person or persons who are the customers.' b) This Agreement' means the Hire Agreement and these Terms and Conditions. In the event of any discrepancy between these Terms and Conditions and any other Motoroamer literature, the provisions of these Terms and Conditions apply d) ‘Customer' means the person or persons nominated as the hirer under the heading 'Hire Details' on the Hire Agreement and any person whose credit card is presented in payment of the customer's charges. g) ‘Day’ Collection and return days are each charged as one day. h) 'Vehicle' means the vehicle described under the heading 'Vehicle Details' on the Hire Agreement and includes tyres, tools, accessories, the living equipment and any other special equipment, documents related to the Vehicle and any replacement or substitute Vehicle which may be provided at the discretion of Motoroamer. a) No one other than the drivers named in the hire form may drive the vehicle. b) Drivers must be between over 21 and under 70 during the whole period of the hire, of good health and have held a full driving licence for 3years. c) Drivers between the ages of 21 and 22 must hold a clean licence free from any endorsements. d) Drivers between the ages of 23 to 24 must hold a clean licence free from any endorsements with the exception of no more than a C rating endorsement in the last 5 years. e) The following drivers will NOT be eligible to drive the vehicle i) Any driver with any A rating endorsement in the last 5 years ii) Any driver who has been disqualified in the past 2 years iii) Any driver who has on their licence any of the following offences iv) Theft or Unauthorised taking(UT) v) Drink or Drugs (DR) vi) Dangerous Driving (DD) vii) Driving whilst disqualified (BA) viii) Any driver who has more than three convictions on their licence ix) Any driver who has had their insurance declined and/or renewal refused and/or cancelled. x) Any driver engaged in or as or connected with any of the following i) American servicemen ii) Professional sportsmen iii) Persons connected with the entertainment or theatrical profession iv) Persons connected with professional racing or gambling f) The following drivers should refer to Motoroamer for eligibility and any additional insurance charges which may apply in the following instances: i) Any driver with any A rating endorsement combined with codes CD40 – 70 over 5 years ii) Any driver with DD, DR or UT endorsements over 5 years iii) Any driver with more than 2 C rating endorsements in the past 3 years. iv) Any driver with a B or C rating endorsement incurring a short period of disqualification v) Any driver with any B rating endorsement relating to an accident or a fine over £100 g) Drivers of the Flash 09 model must have the C1 category on their licence entitlements. h) All drivers of the vehicle must produce current valid driving licences at the time of vehicle collection to include the photocard and paper counterpart (originals only) of the licence. All drivers must provide an additional form of identification (originals only). i) Visitors from abroad must hold a current International Driving Licence. Visitors from outside the EC and ECA will not be entitled to drive the Flash 09 model. j) The final decision on suitability to drive rests with Motoroamer. 4. Insurance a) Fully comprehensive insurance is included in the hire charges. b) The vehicle is insured for the period of hire ONLY and thus late return of the vehicle would constitute a traffic offence under the Road Traffic Act. c) Hirers are advised to take out additional personal holiday insurance to cover their own belongings and personal accident or injury. d) The excess on the insurance policy is £1,000 and in the event of an accident the hirer will pay Motoroamer an additional £500 to top up the security deposit to this amount. e) Any damage to the vehicle which is not covered by an insurance claim will be deducted from the refundable deposit. . This excess applies to each and every incident and it includes any loss or damage to equipment, fixtures including damage to tyres, wheels and wheel trims, loss of roof lights or damage to third party vehicles or property. f) The hirer is entirely responsible for any accidental damage, injury or consequential loss after the expiry of the hire period. 5. Loss a) No claims by the hirer will be considered in respect of any loss or damage to personal belongings or effects of the hirer or any person or persons. 6. Exclusion and Liability a) Motoroamer shall not under any circumstances be liable to make any payment to the hirer in respect of or to indemnify the hirer against loss, injury or damage sustained by the hirer or any third party as a result of the presence or use of the vehicle or as a result of any defects therein and in taking delivery of the vehicle the hirer shall be deemed to have satisfied himself that it is in all respects roadworthy and in proper and safe condition 7. Hire rates a) Hire rates quoted include: *Insurance loading. In some cases, Motoroamer will incur additional charges if the driver to be insured has a traffic conviction, is using a non-UK driving license or is in an occupation which is deemed high risk. These charges will be passed onto the customers. 7. Booking Deposit a) A deposit of 20% of the hire cost is payable on reservation and will be deducted from the total hire charge. b) This deposit is not refundable in the event of cancellation by the hirer. 8. Payment a) Payment of the deposit or the remaining balance will be accepted by cash, personal cheque, debit and credit card. We accept Switch, Visa and MasterCard only. Payment can be made on line, by telephone or by post. We require 14 working days to clear a personal cheque. b) Payment of the balance must be made in full two weeks prior to the date of commencement of the hire or at the time of booking if later. Cheques will not be acceptable for late bookings made less than 2 weeks prior to departure. c) If the payment is not made on time, the booking will be regarded as unconfirmed and Motoroamer reserve the right to cancel the booking. 9. Security deposit a) A security deposit of £500 is payable per hire. This is fully refundable within ten days of the vehicle being returned to the agreed location, on the agreed date and time, in the same condition as it was let out, with the toilet empty, the interior clean including all cooking appliances, the fuel tank full, the waste water tank emptied and flushed through with clean water and all equipment complete and undamaged. b) Standard Charges will apply as follows in the following situations: i) Un-emptied toilet cassettes £50 ii) Deep clean required of interior £75 iii) Fuel £1 per litre iv) Un-emptied and flushed waste water tank £25 v) Fridge not emptied off £10 vi) Cooker hob and grill un-cleaned - £25 vii) Crockery, cutlery and cooking equipment left unwashed – £25 c) Please note facilities are NOT available at the Motoroamer premises to empty toilets or tanks. d) Other damage and loss will be charged on a cost basis. e) Should any damages exceed the security deposit the customer will be responsible to settle all additional costs over and above the security deposit value. f) The security deposit may be paid in cash at the time of departure or by cheque, debit or credit card on the same payment terms as the balance of the hire charge. g) The security deposit will only be refunded once a full inspection of the vehicle, equipment and contents has been made. If you wish to receive back the security deposit on return of the vehicle you must allow at least one hour from return for the full inspection to be made. 10. Cancellation a) All cancellations must be in writing. b) If cancellation is received i) More than 6 weeks prior to the commencement of hire, the booking deposit will be forfeited. ii) 6 to 2 weeks prior to the commencement of the hire – 50% of the total hire charge iii) less than 2 weeks prior to the commencement of the hire – 100% of the total hire costs iv) no show – 100% of the total hire costs c) The security deposit is fully refundable in the event of a cancellation or no show provided that no other sums are unpaid by way of deposit or otherwise. d) Motoroamer reserves the right to cancel hire if, at the commencement of hire, the drivers’ licences and other identification documentation are invalid or not according to the terms and conditions or if the security deposit has not been paid in accordance with the terms and conditions. In these circumstances the total hire charge will be forfeited. e) Hirers are strongly advised to insure against unavoidable cancellation. 11. Care and Custody of the vehicle a) The hirer shall only drive the vehicle while qualified to do so and whilst holding all necessary and current licences and shall at all times drive the vehicle in a careful and skilful manner in accordance with all legal requirements. b) The hirer shall not use the vehicle for racing, pacemaking or any other purposes other than domestic and social purposes and shall not carry any passengers in the vehicle for hire or reward. c) The hirer must use the vehicle in a reasonable and proper manner and the hirer is liable for any damage fault or loss to or in the vehicle or it’s fixtures and fittings as a result of the hirers or other passengers’ negligence or misuse of the vehicle and is also liable for any damage above cab height. d) The maximum number of persons carried in the vehicle shall be no more than the maximum number of sleeping berths. e) The hirer shall not take the vehicle off the English, Scottish or Welsh mainland without prior consent of the Company. f) The hirer shall at no time pass possession or custody of the vehicle to any other person. g) The vehicle must be locked at all times when left unattended. h) The hirer shall ensure that the driver and passengers required by law to do so shall, at all times when the vehicle is being driven, wear the seat belts provided. 12. Breakdowns and accidents a) In the event of a breakdown or accident, recovery services are at the full disposal of the Hirer. b) Instructions for repair or replacement, at a cost not exceeding £75 may be given by the hirer who will be reimbursed on the production of a receipted invoice at completion of hire. c) Company approval must be obtained in respect of repairs/replacement in excess of £75. d) The Company will not be responsible for hotel or any other expenses subsequent to a breakdown, nor will they be under any liability for third party claims or damages with any accident or breakdown. e) In the event of an accident involving the vehicle, the hirer shall notify the Company by telephone immediately after the event or as soon as practicably possible, thereafter a completed accident report form must be handed to the Company at termination of hire. f)The maximum height of your vehicle is clearly stated. Any overhead damage is the responsibility of the hirer over and above the £1,000 excess. g) Damage of any kind to the vehicle or the equipment must be reported to Motoroamer immediately so that replacements can be sought as soon as possible. Failure to do so where subsequent hires are affected as a result will incur a penalty charge of £75 per day the vehicle is unavailable for hire. 13. Smoking a) The Company operates a strictly enforced no smoking or naked flame policy in all vehicles. ANY OFFENDER WILL FORFIET THEIR SECURITY DEPOSIT 14. Pets a) All pets other than guide dogs have to be approved by Motoroamer at the time of booking. If approved, all damage however caused by the pets will be charged to the hirer in full. 15. Parking a) Customers are welcome to leave their vehicles in the Company’s secure premises during the hire period (maximum of two per motorhome). b) Vehicles are left at the owners’ risk. 16. Fuel, Oil and Coolants a) These items are at the hirers’ expense. b) Vehicles are supplied with a full tank of fuel and should be returned full. The cost of any shortfall will be born by the hirer (see Security deposit terms above). c) The hirer is liable if incorrect fuel is used. d) The hirer will be responsible for maintaining the correct level of engine oil and coolants. Failure to do so may result in engine damage for which the hirer will be responsible. 17. Gas a) Two gas bottles are provided with the vehicles at the time of hire, at least one of these will be full. b) The cost of any refills thereafter will be the responsibility of the hirer, who shall also ensure two bottles of the same type and size are returned with the vehicle. 18. Fines a) All fines incurred by the hirer for infringement of traffic laws or regulations and tolls are the responsibility of the hirer and must be settled by that person. b) The hirer also agrees to reimburse the Company in respect of any cost and expense incurred by the Company in recovery of such fines and penalties from the hirer. 19. Availability a) Motoroamer reserves the right, at its absolute discretion, to substitute a comparable or superior Vehicle for the Vehicle. In that event, the hirer shall not be liable for any increased rental or other charges save for any addition running costs pertaining to the substitute vehicle. Such substitution shall not entitle the hirer to any refund and does not constitute a breach of this Agreement. b) If for any reason the vehicle is not available, Motoroamer will return in full any monies paid. In this event the hirer will have no claim of any kind against Motoroamer. c) Motoroamer reserve the right not to supply a replacement vehicle in the event of an accident or breakdown caused by the recklessness or negligence of the hirer. a) Vehicles are available for collection on the first day of hire between the hours of 2 pm and 6 pm. Please allow 1 hour for the hand over at the depot to complete the documentation and demonstrate the vehicle to you. b) Vehicles must be returned between 9 am and 11 am on the final day of hire. c) Collection and return may be arranged at other times by arrangement. d) Your cooperation in returning vehicles at the arranged time is essential in order that the vehicle will be clean and available for the next hirer. e) No refund is available for early return of vehicle. f) Failure to return the vehicle within the agreed time on the last day of hire means the vehicle is not insured and renders the hirer to criminal prosecution. g) Failure to return the vehicle on time also incurs a penalty charge of £50 per hour or part thereof, together with any additional costs incurred by the Company. h) Delivery and collection of the vehicle to a location other than the Motoroamer premises can be arranged at an additional charge. 21. Shopping service a) We cannot take any responsibility for items not available, substitutions. or the quality of the items chosen by the supermarket or yourselves. b) We will accept whatever the supermarket deems a suitable replacement. c) We cannot take responsibility for any problems arising out of your shopping order. |
